This agreement adds to our Domain Name Registration Agreement for Australian domain names, including .au, .com.au, .net.au, .org.au and .id.au. We register .au domains through an auDA-accredited registrar partner.
1. The licence
- 1.1A .au domain is licensed to you for a set period (usually 1 to 5 years), not owned. The licence is governed by the .au Domain Administration Rules: Licensing and other policies published by the .au Domain Administration Ltd (auDA), as updated from time to time.
- 1.2You agree to comply with those rules and policies, and with the terms auDA requires registrars to pass on to registrants. If anything in this agreement conflicts with auDA's rules, auDA's rules apply.
2. Eligibility
- 2.1To hold a .au domain you must have an Australian presence as defined by auDA, for example an Australian business number (ABN), Australian company number (ACN), an Australian registered trademark (or a pending application), or Australian citizenship or residency for some namespaces.
- 2.2For .com.au and .net.au, the domain must also match or be closely connected to your name, trademark or a service or product you provide, as required by auDA's allocation rules.
- 2.3When you order, you'll give your eligibility details (such as your ABN or ACN). They must be your own and correct. We and our registrar partner may check them with the relevant registers.
3. Your warranties
- 3.1You confirm that everything you tell us about eligibility is true and complete, that you'll keep meeting the eligibility rules for the whole licence period, and that you'll tell us if you stop meeting them.
- 3.2You confirm that registering and using the domain doesn't infringe anyone else's rights, and that you're not registering it only to sell it or to stop someone else having it.
4. Audits, suspension and cancellation
- 4.1auDA or our registrar partner may audit your eligibility at any time. If you don't meet the rules or don't respond to an audit, the licence can be suspended or cancelled, and no refund is due.
- 4.2auDA may also suspend or cancel a licence under its policies, for example following a complaint or a decision under the .au Dispute Resolution Policy (auDRP).
5. Disputes and complaints
- 5.1Disputes about who should hold a .au domain are resolved under the auDRP, not by us.
- 5.2If you have a complaint about our .au services that we can't resolve under our Customer Service and Complaints Policy, you can contact auDA.
6. Privacy
- 6.1auDA and the registry receive your registrant details. Some details, such as the registrant name and eligibility, may appear in public lookups as auDA's policies allow. See our Privacy Policy.
7. Renewals and transfers
- 7.1Licences renew for the period you choose, following our Domain Name Registration Agreement. You must still be eligible at renewal.
- 7.2Transfers between registrars follow our Domain Transfer Policy and auDA's rules. Changing the registrant (the licence holder) may need a separate process and checks.
